Additional tips
  • Pinpoint references to an Act usually include an abbreviation of a designation, eg s (section), sch (schedule), cl (clause) (see AGLC4 Rule 3.1.4 for a full list of abbreviations)
  • When a short title is given to a portion of an Act, delegated legislation or Bill, the short title should be placed after the pinpoint, eg Criminal Code Act 1995 (Cth) sch 1 ('Criminal Code') (AGLC4 Rule 3.1.7)

Bills (AGLC4 rule 3.2)

Bills are referred to in the same way as Acts, except their titles are not italicised.

Delegated legislation (AGLC4 rule 3.4)

Delegated legislation (regulations, rules and orders) are cited similar to Acts.

  • Use the abbreviations in rule 3.1.4 and 3.4 to refer to pinpoints of delegated legislation eg ord (order), reg (regulation), r (rule), ords (orders), regs (regulations), rr (rules)

Australian constitutions (AGLC4 rule 3.6)

The Constitution of the Commonwealth of Australia may be cited as the Australian Constitution, the Commonwealth Constitution or the Constitution if there is no ambiguity as to which constitution is being cited.

 eg Australian Constitution s 51(ii).

If necessary it may also be referred to within its enacting legislation

eg Commonwealth of Australia Constitution Act 1900 (Imp) 63 & 64 Vict, c 12, s 9.

The constitutions of individual states should be cited as you would an Act

eg Constitution of Queensland 2001 (Qld) s 3. 

Explanatory memoranda, statements or notes (AGLC4 rule 3.7)

Explanatory Memoranda are also known as Explanatory Statements or Explanatory Notes. Use the term that is referred to in the source you are referencing.

  • The citation to the Bill should adhere to rule 3.2
  • Pinpoints should be to pages or paragraphs (or both) in accordance with rules 1.1.6-1.1.7 (see General rules)
